Customers who use and purchase from this e-commerce site are deemed to accept the following conditions:
The web pages on our site and all linked pages ("site") are owned and operated by Sennorita (the "Company"). By using the services offered on the site, you ("User") agree to be bound by the following terms. By benefiting from the service on the site and continuing to use it, you represent that you are over 18 years of age, that you have the legal authority and capacity to enter into a contract under the laws applicable to you, and that you have read, understood and agreed to the terms of this agreement.
This Agreement imposes rights and obligations on both parties in relation to the Site. Both parties agree to perform these rights and obligations in a complete, accurate and timely manner as specified in this Agreement.
- RESPONSIBILITIES
a. The Company reserves the right to make changes to prices and services offered at any time.
b. The Company agrees and undertakes that the User will benefit from the services covered by the Agreement, except in the event of technical failures.
c. The User agrees in advance that he/she will not reverse engineer the site, attempt to find or obtain its source code, and that he/she will be liable for any damage caused to third parties, facing legal and criminal consequences.
d. The User agrees not to produce or share any content that is contrary to morality, law, third party rights, misleading, offensive, obscene, pornographic, violates personal rights, infringes copyrights or encourages illegal activities in their activities on the site or in their communications. Otherwise, the User will be solely responsible for any damage caused, and the authorities of the "Site" reserve the right to suspend or terminate such accounts and initiate legal proceedings. The site also reserves the right to share information with judicial authorities if requested.
e. Relations between members of the site and third parties are the sole responsibility of the members.
- Intellectual Property Rights
2.1. All intellectual property rights in titles, trade names, trademarks, patents, logos, designs, information and methods, whether registered or not, belong to the site operator or its designated party and are protected by national and international law. Visiting the site or using the services does not grant any rights to these intellectual property rights.
2.2. The information on the site may not be reproduced, published, copied, displayed or transmitted in any way. No part of the site may be used on another website without permission.
- Confidential Information
3.1. The Company will not disclose personal information communicated by users through the site to third parties. This personal information includes any other details to identify the User, such as name, surname, address, telephone number, mobile phone number and email address, collectively referred to as "Confidential Information."
3.2. The User consents to the sharing of his/her contact, portfolio and demographic information for marketing purposes with the Company's subsidiaries or group companies for promotional activities, campaigns, advertisements and other marketing purposes. These personal details may be used to determine customer profiles and conduct statistical studies.
3.3. Confidential Information may only be disclosed to public authorities if officially requested in accordance with legal procedures or if required under applicable legal provisions.
- No Warranty
THIS SECTION OF THE AGREEMENT SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE COMPANY PROVIDES THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS, INCLUDING ALL INFORMATION CONTAINED THEREIN, WITHOUT ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- Registration and Security
The User must provide accurate, complete and up-to-date registration information. Failure to do so will result in a breach of this Agreement and the User's account may be terminated without notice.
The User is responsible for the security of his/her password and account information on the Site and on third-party sites. The Company cannot be held liable for any loss of data, security breaches or damage to hardware or devices.
- Force Majeure
In the event of force majeure beyond the control of the parties, such as natural disasters, fires, explosions, wars, riots, public disturbances, strikes, infrastructure or internet failures, or power outages (hereinafter referred to as "Force Majeure"), if the obligations arising from the agreement cannot be fulfilled, the parties shall not be liable. During this period, the rights and obligations of the parties under this agreement shall be suspended.
- Complete Agreement and Execution
If any part of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Changes to the Agreement
The Company reserves the right to change the services and terms of this agreement in whole or in part at any time. Changes will be effective upon posting on the site. It is the User's responsibility to follow these changes. By continuing to use the services, the User will be deemed to have accepted these changes.
- Notifications
All notices relating to this Agreement shall be sent to the email address specified by the Company or to the email address provided by the User in their membership form. The User agrees that the email address provided by them is a valid notification address and that any changes will be reported within 5 days. Otherwise, notices sent to the address provided shall be deemed valid.
- Trial Agreement
In the event of any dispute arising from this agreement, the parties agree that the company's books, records and documents, as well as computer and fax records, shall be considered as evidence in accordance with the provisions of the Turkish Civil Procedure Code, and the User shall not object to these records.
- Dispute Resolution
The courts and enforcement offices of the Istanbul Palace of Justice (Central) shall have jurisdiction over any dispute arising from the application or interpretation of this Agreement.
